Agentic eDiscovery is the newest tier of review technology, and it is also the most oversold. Pro-Legal Services, Inc. runs managed document review and AI document review for law firms, corporate legal departments, and government agencies, which means we evaluate these tools on real matters rather than in demonstrations. This is an honest account of what each tier does, where agentic review genuinely helps, and what it does not relieve you of. We run these tools on live matters, which is why this reads as an assessment rather than a brochure.
The Review Technology Ladder
Five tiers, in order of maturity. Keyword and Boolean search remains the baseline and is still correct for small, well-scoped collections. TAR 1.0, classic predictive coding, trains a classifier once against a fixed seed set. TAR 2.0, continuous active learning, retrains continuously as reviewers code and is the sensible default for most matters today. Generative AI review layers a large language model relevance scorer on top, scoring each document against an issue described in plain language. Agentic review sits above all of it. Where a matter uses an agentic workflow, we document the agent chain and preserve the reasoning traces as part of the record, because an automated call nobody can reconstruct is the one that gets challenged.
What Makes Agentic Review Different
Agentic review is a multi-step workflow rather than a single scoring pass. Rather than rating documents one at a time, AI agents retrieve related material across the collection, identify patterns across custodians, reconstruct timelines, and produce a per-document reasoning trace explaining why a call was made. That reasoning trace is the meaningful difference. A generative AI scorer returns a number; an agentic workflow returns an argument you can inspect, which matters when a privilege or responsiveness call is challenged.
Where It Helps, and Where It Does Not
Agentic review is a narrow frontier capability in 2026, not a replacement for a review team. It is genuinely useful for investigation-style work where the question is what happened rather than which documents are responsive, for timeline reconstruction across many custodians, and for early case assessment on collections too large to scope by hand. It does not reduce your validation obligations, it does not eliminate human privilege review, and on a straightforward responsiveness review continuous active learning will usually deliver the same result for less money and less explaining.
Defensibility Comes First, Whatever the Tier
Every tier carries the same obligations. Document the review protocol before production work begins. Validate the result with elusion testing against the null set and report precision and recall at a stated confidence level. Be ready to describe the workflow during ESI protocol negotiation, since opposing counsel is entitled to understand the process even where the specific technology is not mandated. Where an agent influences responsiveness or privilege calls, document the agent chain thoroughly, because an unexplained automated decision is the one a court will scrutinize. We recommend counsel obtain a Rule 502(d) order before production in any matter where AI touches privilege.
Technology choice sits inside a larger process. Pro-Legal provides the forensic data collection and ESI processing that precede review and the defensible production that follows through our eDiscovery services, runs the review itself through managed document review, converts paper records with legal document scanning and litigation copying, and handles foreign-language material with certified legal translation and multilingual review.
