State and Local Government Litigation Support

A county attorney’s office and a federal agency buy the same services under completely different rules, on completely different money, with completely different public-records exposure. Treating them as one market is how vendors lose both.

State and local government litigation support is a separate market from federal work, and the differences are procedural rather than technical.

Four things that are genuinely different

  • There is no single rulebook. Each state, county and city has its own thresholds, term contracts, cooperative purchasing arrangements and sole-source procedures. A federal capability statement is not the document that gets you onto a state term contract.
  • Public records law. State open-records statutes are not FOIA, and the deadlines are frequently shorter. The same records that are discovery material in a lawsuit are also subject to a public records request from a journalist, often at the same time, with different redaction rules applying.
  • Budget cycles. Fiscal years and appropriation cycles do not match the federal calendar, and a project that cannot be invoiced before a cycle closes may not happen at all.
  • Volume profile. A municipal law department runs a large number of smaller matters rather than a small number of large ones — employment, civil rights, land use, contract disputes, tort claims. The buying problem is a steady stream of mid-sized projects, not an occasional terabyte.

That last one changes what a vendor should be selling

A hosted platform priced for enterprise volume is a bad fit for an office running forty matters of modest size. So is a minimum-commitment arrangement. What fits is per-matter work with no floor, predictable unit pricing and the ability to turn a small project around without a procurement event.

We have no minimum engagement size for exactly this reason, and our review cost runs twenty to thirty percent below conventional because the platform is ours rather than licensed. On a portfolio of small matters that difference compounds in a way it does not on one large one.

The public records overlap is the trap

A set of documents collected for a lawsuit will often also be responsive to an open-records request. The exemptions are different, the deadlines are different, and the redactions are different — which means the same population may need two distinct redaction treatments, and applying the litigation redactions to the records release, or the reverse, is a serious error.

We handle both, and we keep the two treatments separate and separately logged rather than trying to make one serve both purposes.

What we deliver

  • eDiscovery and forensic collection, remote or on site
  • Document review by trained non-attorney reviewers to your protocol
  • Records digitization and structured indexing, including legacy paper files
  • Public records redaction, logged separately from litigation redactions
  • Production to the format the court or the requesting party requires
  • Certified translation, with ATA-certified staff translators in house — relevant to any jurisdiction with language access obligations
  • Trial sets, exhibit indexing and demonstratives

Where we work

Our office is in Arlington, Virginia, which puts us inside the local radius for Virginia and Maryland jurisdictions and the District — Baltimore, Annapolis, Alexandria, Fairfax, Richmond and the surrounding counties — with remote collection, hosting and production for jurisdictions elsewhere.

Being close enough to collect a dozen boxes the same week matters more at this level than it does on a federal program.
